This is a response to a recent 1-star review by a "local guide." The review was solely based on the buyer representation agreement/contract which I assume wasn't signed by the buyer. Regardless: nearly every other brokerage will have nearly identical clauses and stipulations. So to single out one brokerage in particular is unfair at best and quite possibly dubious. This is no different than leaving a bad restaurant review for getting your food delivered late and predictably cold. It's just something to be expected. Also, all contracts are negotiable. Meaning that you are entitled to amend the contract or rewrite it entirely. But in case anyone is interested in enlisting the services of Coldwell Banker McMullen, I know firsthand that that office is amazingly diligent and professional. Especially the front desk staff, and especially Sandy.
I am compelled to share my profoundly disappointing experience with Coldwell Banker Realty in Chicago, especially concerning their Buyer Representation Agreement. The aspects of this contract are nothing short of disturbing, leading me to question whether the individual who authored it was in possession of a sound mind—or perhaps fueled by something far more sinister. Firstly, the phrase “any property” serves as an ominous red flag in this vampiric contract. Are we truly expected to believe that “property” could extend to anything from residential real estate to my collection of baseball cards, a piece of modern art, or even my beloved family pet? This type of vague language is alarmingly reckless and opens the door for Coldwell Banker to engage in cautious, opportunistic vampirism, staking a claim on commissions for virtually any acquisition a buyer might make. Who thought it prudent to craft a contract that allows for such absurd interpretations? Surely, the intention reeks of dishonesty and manipulation. Moreover, the provisions are excessively one-sided, showcasing an evilness that is all too common in the industry. Section 3 demands that buyers adhere to various commission structures without clear, upfront explanations of how these fees are calculated or justified. The lack of transparency feels like a scare tactic designed to lull consumers into compliance rather than foster an honest business relationship. Coldwell Banker’s tactics resemble those employed by predators rather than reputable agents dedicated to assisting clients. The indemnification clause is another disconcerting aspect of this sinister agreement. It places an inordinate burden on the buyer, ultimately agreeing to defend the Broker against any and all claims while severely truncating the recourse available if the Broker engages in misconduct. Such excessive liability placed on buyers is not just unreasonable—it embodies dishonesty that virtually invites exploitation. Additionally, the so-called “Possibility of Dual Agency” section paints a chilling picture. The expectation that one agent can effectively represent both conflicting interests—the buyer’s right to negotiate fairly and the seller’s desire to maximize profit—feels like an ethical dilemma dripping with deceit. It raises serious concerns about the integrity of the process and whether anyone involved understands the implications of such a dual representation. The grim possibility of navigating this scenario only serves to heighten the scary atmosphere. If this contract is indicative of Coldwell Banker’s approach to real estate in Chicago, I would strongly advise potential buyers and sellers to reconsider their options. The absence of transparency, coupled with these vampiric tactics, means that the relationship with Coldwell Banker appears rooted in exploitative practices rather than genuine advocacy for the client’s best interests. In a market that should be governed by trust and mutual respect, it is disheartening to encounter a company that prioritizes its own financial gain over the well-being of its clients. I find myself compelled to urge anyone considering Coldwell Banker Realty to proceed with extreme caution, lest you find yourself entangled in a contract that feels more akin to an evil scam than a fair business agreement.
